These General Terms and Conditions of Service and each Service Order constitute the complete agreement (“Agreement”) between Servexel LLC and Customer and supersede all prior or contemporaneous agreements or representations, written or oral. It is your responsibility to familiarize yourself with SERVEXEL LLC General Terms and Conditions of Service, prior to allowing our technician to commence work. Allowing our technician to commence service constitutes acceptance of all terms and conditions detailed herein.
- Service call fee: We charge a non-refundable service call fee for all non-warranty or 3RD PARTY covered diagnostic visits to Customer’s residence, property or business. This fee covers costs incurred by us for travel and the performance of diagnostic service for one appliance by Servexel LLC technician. We charge a separate Service call fee for each appliance we examine and diagnose. The Service call fee is NON-REFUNDABLE. The Service call fee must be collected from the customer PRIOR TO, OR AT THE TIME OF THE INITIAL VISIT. Our technicians CANNOT inspect, check, discuss, recommend, or “look at” any appliance without first documenting the appliance in our records and charging the appropriate additional Service Call/Diagnostic fee.
- Estimate and Repair charges: Estimates provided are not a guaranteed price and are an estimate of the cost of service based on initial site visit, if applicable. Pricing may vary based on several factors and availability of parts can change at any time. An estimate is valid for 7 days. The customer is responsible for reviewing the entire estimate with the technician before signing. The customer signature indicates approval and complete agreement with having the repair performed at the price quoted. In cases where additional research is required we will provide a completed estimate within 48 hours of the initial date of visit. In the event additional parts are needed or part pricing has changed, a revised estimate may be collected at the time of the service call. The estimate may be withdrawn by us if not accepted within 90 days of submission. The repair price is based on the job complexity, not on the time the repair takes to perform. Payment is due and will be collected upon completion of the services unless we agree otherwise specified in writing. Any returned check or bank draft will be charged a processing fee of $25.00. You agree to pay all expenses incurred by Servexel LLC for the collection of any unpaid amounts including, but not limited to all attorney’s fees, filing fees, and costs. Past due amounts shall bear interest at the annual rate of 18%, or the maximum otherwise allowed by law, whichever is less. No refunds on completed repair.
- Appointment(s): Our appointments have a 2 hour window. All appointments are set based on the earliest availability. Part installation appointments are not scheduled until the parts have arrived.
- Diagnosis: Based on the problem(s) the customer describes and upon examination, a SERVEXEL LLC technician will determine what repair he/she finds necessary to resolve the problem(s). Full access to the unit must be provided by the customer. In case access to the unit is not provided by the customer, additional fees may apply for the labor performed to access the unit. Due to the complexity of some appliances there can be additional underlying problems that cannot be determined until an “initial repair” is made. In the event an appliance has an underlying problem(s), an additional free diagnosis along with an additional revised estimate will be provided. If the technician arrives and no problem is present, it will be considered as a diagnosis of “Working as designed”, and the customer is responsible for the service call fee. If the problem is caused, or possible caused by a source other then the appliance itself, the technician may recommend an examination by an outside trade contractor to confirm or rule out the possible cause or problem. The customer is fully responsible for any expenses, cost and payment for any examinations or services performed by outside trade contractors.
- Recommendation(s): Any recommendation(s) made by our company are not mandatory, and any actions taken by the customer at the sole discretion and financial responsibility of the customer.
- Parts: Technicians carry the most commonly required parts to perform a repair. Sometimes the parts will need to be ordered and additional shipping and handling charges may be applied. Orders for parts are placed within 24-72 hours upon estimate approval. Depending upon part availability, most parts arrive between 1-5 business days. Upon receiving the part, the customer will be contacted to schedule the part installation. We reserve the right to keep old parts and components that have been replaced by SERVEXEL LLC technicians. Back-ordered parts: In case the part is back-ordered, SERVEXEL LLC will keep the customer informed. Discontinued / No Longer Available parts: When a part is discontinued or no longer available through manufacturer, SERVEXEL LLC will not perform any repair.
- Maintenance: Problems with appliance may be caused solely by lack of routine maintenance. Sometimes just maintenance may resolve the problem. Maintenance may be needed / required before repair or during repair. Maintenance is not a repair or part of repair labor. Maintenance is non-refundable.
- Canceling Service/Repair: Any cancellation is subject to a 25% restocking fee. Refunds can take up to 4 weeks to process. No refunds on special order parts.
- Good Faith working relations: Please courteous and professional with technicians and our office staff. Threatening or aggressive behavior toward our staff will result in the immediate termination of service and/or future service. Any request for illegal or fraudulent actions will result in immediate termination of service and/or future service. Please do not request a technician or staff obtain you a replacement or exchanged product. It may be necessary to remove an APPLIANCE from your residence or property for extended troubleshooting and/or diagnostic testing. You will be asked to consent to this on the WORK ORDER document, if deemed necessary for an effective repair and/or diagnosis.
- Technician Safety: You understand and agree that it is your responsibility to make available a safe, accessible and clean work area at your property, home and/or business. You must provide the technician a safe, legal parking space within a reasonable distance of the work area. The APPLIANCE must be in a serviceable position, accessible to our technician(s). , within an appropriately climate controlled structure, free of hazards or encumbrance.
- Warranty/Service Liability Release/Damage Waivers. It is your responsibility to familiarize yourself with Seller’s Warranty Terms and Damage Waivers, prior to allowing our technician to commence work.
Customer pets, dogs, and/or other animals are not permitted within a technician’s work area.
The presence of an aggressive dog or other animal in the work area will not be tolerated and will result in termination of service and/or future service. You understand and agree that any workplace injury sustained from any dog bite and/or animal attack will be documented and prosecuted under the full extent of any applicable laws, and will be grounds for immediate termination of any service and/or future service without notice. We require an adult be present during service work due to the complex and dangerous nature of an emergency onsite repair call. A technician can be working with flammable gasses or other dangerous tools. You understand and consent to the on-site use of oxygen, acetylene, propane, butane and/or other flammable gasses such as refrigerants or inert purge gasses. You understand and consent to the use of open flame torches, electrical soldering and/or brazing equipment and the presence of dangerous sharp metal edges, electrical, fire, gas hazards, and/ or dangerous tools in the work area.
